Google Questions Government's Intentions
Objects to its act of taking sides in a case between two private parties.
After Communications and IT Minister Kapil Sibal did a full volte-face with his comments about not censoring social media, Google and Facebook have raised doubts on the government's intention. Talking about their role in the case pertaining to the issue of publishing objectionable content online in the Delhi High Court, Google India's lawyer NK Kaul argued, "We are curious as to why the Union of India has become a party to a case between private parties? It might be a case of mala fide intention, which we leave to the judgement of the Hon'ble Court".
In response, Naveen Sharma, senior counsel who is presenting the case on behalf of the Delhi Police said, "The government has all rights to intervene. The government called the representatives of these internet companies (Google, Facebook) in October 2011, and asked them to remove the content. But they did not comply".
He also produced evidence in form of request letters to remove content which was exchanged between India's Computer Emergency Response Team and the websites. The case was filed by journalist Vinay Rai, for "objectionable" use of images depicting Indian gods online.
Both Google and Facebook have asked for time to file replies. The next hearing in the matter has been scheduled for 16th February.
